Foreign Office, July 29, 1910. I TRANSMIT to you herewith, for your Excellency's information, and for any observations you may have to offer, copy of a despatch from Mr. Max Müller,† relative to a claim preferred by a British firm, Messrs. Samuel and McGregor, against the Chinese Government in connection with the alleged non-fulfilment of certain contracts for soya beans.
Your Excellency will observe that Mr. McGregor has given the Chinese official with whom he has been negotiating a verbal promise that if certain mining concessions in Manchuria were given to the firm the latter would take no further steps to recover the losses sustained over the bean contracts. The concessions referred to are the coal mines at Foong-mi-Shan and Ho-shi-ling, in the province of Kirin.
As it is not apparently clear whether these mines lie within the area where the Russians and Japanese may claim to have mining rights in virtue of their railway agreements with China, I do not for the present propose to take any action in the matter.
